Delaware Supreme Court Unanimously

Affirms DBE Plat Plan Approval & Building Permit

Media Advisory – For Immediate Release

June 10, 2013

E. Thomas Harvey, III, President, Dewey Beach Enterprises (DBE), today released the following statement:

“Earlier today the Delaware Supreme Court unanimously affirmed the two earlier Chancery Court decisions upholding the DBE’s plat plan approval and building permit from the Town of Dewey Beach to construct a 45 foot mixed-use commercial center at Ruddertowne (now named Lighthouse Cove) including a new hotel.

After many years of public meetings and input regarding this project, we are extremely grateful for the expeditious manner with which the Supreme Court of Delaware reached its unanimous decision recognizing our legal right to open for business this summer, and also affirming the Chancery Court of Delaware’s same legal conclusion. The Hyatt Place Hotel and the 16 penthouse condominiums being built in Phase 1 of this project are nearly complete and we expect to open the hotel and deliver the sold condominiums by mid-summer.

After 7 years of controversy, it is our fervent hope that the needless rancor related to this project can be set aside so that Delaware can get back to work. We invite all those who love Dewey Beach to support our legacy project and the many amenities it will bring to Dewey Beach and the entire Delaware coastline.

We are working closely with the Town of Dewey Beach, Sussex County, The State of Delaware, and the United States Army Corps of Engineers to assure that this project meets all required standards and contributes in a positive way to the environment and to the community.

The resort project is already of major economic benefit to the local economy, providing hundreds of construction and permanent jobs. Upon full phase 2 build-out, the project will add millions to Town, Sussex County, and State revenues; and will be an asset to the Delaware coastline for decades to come.

Tomorrow, DBE will host a Job Fair to complete the staffing the new Hyatt Place Hotel. Speaking for my entire team, we are eager to welcome new associates to our organization with this legal matter now concluded.”
